10-Day Offer Guarantee — Program Terms
Program Overview
The 10-Day Offer Guarantee is a performance-based marketing program offered by Michael Keith to eligible home sellers. If the property does not receive at least one bona fide written purchase offer within ten (10) calendar days from the official MLS launch date, Michael Keith will reduce his compensation by $1,000 at closing.
Eligibility Requirements
1. Service Area
The property must be located within the East Tennessee service area covered by the Knoxville Area Association of REALTORS®, and within a 40-mile radius of ZIP code 37922.
2. Listing Price
The seller must agree to a mutually determined listing price supported by a comparative market analysis (CMA) and Michael Keith’s professional pricing strategy.
3. Listing Agreement
The seller must enter into an Exclusive Right to Sell listing agreement with Michael Keith for a minimum term of 90 days. The seller must also agree to a minimum commission rate of 3% or higher for the 10-Day Offer Guarantee and the associated commission reduction to apply.
4. Property Condition & Launch Preparation
Before going live, the property must:
- be clean, decluttered, and ready for showings
- be prepared for professional photography and media
- allow for high-quality marketing assets provided by Michael Keith
5. MLS Launch Date
The 10-day guarantee period begins on the official MLS activation date agreed upon by both parties.
6. Definition of a Qualifying Offer
A “bona fide written offer” is defined as a legitimate, signed purchase offer from a ready, willing, and able buyer, accompanied by a mortgage pre-approval letter or acceptable proof of funds.
7. Seller Cooperation During the 10-Day Period
The seller must allow reasonable access for showings and may not impose limitations or restrictions that materially reduce showing availability during the 10-day guarantee window.
Program Conditions
8. Completion of Transaction Required
The $1,000 reduction in Michael Keith’s compensation is applied only at closing and only if the property sells during the term of the listing agreement.
9. Exclusions
The guarantee does not apply to:
- Properties valued at less than $100,000
- Distressed, severely damaged, or uninhabitable properties
- Properties with title or deed restrictions that impede or delay a normal sale
- Situations in which the seller rejects, ignores, or fails to respond to a qualifying offer within the 10-day period
- Listings canceled or terminated prior to the completion of the 10-day guarantee period
- Properties where seller-imposed restrictions prevent reasonable showing access
Program Fulfillment
If no qualifying written offer is received within the 10-day period and all eligibility criteria have been satisfied, Michael Keith will apply a $1,000 reduction in his commission at closing. This reduction will appear on the final settlement statement prepared by the closing agent.
